Access to Care

CT 2009 HB 6600 Introduced An act concerning the creation of the "SustiNet Plan" a self-insured health care delivery plan, administered by the authority and operated by a public-private partnership, that is designed to ensure that plan enrollees receive high-quality health care coverage without unnecessary costs.   CHCs and other providers shall follow a developed method to: (A) Identify uninsured individuals who seek health care, and (B) convey such information to the board and said department to facilitate the potential enrollment of such individuals into health insurance coverage.
IA 2009 SR 9 Introduced A resolution encouraging a federal state collaboration to achieve quality, affordable health care for all.
MD 2009 HB 1186 / SB 881 Introduced This  bill  establishes  a  single-payer  Maryland  Health  System  to  (1)  provide comprehensive  and  coordinated  health  care  coverage  that  is  not  dependent  on employment  to  all  State  residents;  (2)  reduce  costs;  and  (3)  establish  mechanisms  to reduce medical errors, decrease health disparities, resolve provider shortages, and insure transparency and accountability.
OR 2009 HB 2523 Introduced A bill that establishes Oregon Health Access Fund and Core Health Safety Net aimed at maintaining or expanding access to medical and dental care through school-based health clinics and community health centers.
WA 2009 HB 1519 / SB 5140 Introduced Requiring language access services for persons with limited English proficiency in health care and insurance matters.

IL 2008 HB 6526 Pending Appropriates $310,734,650 to CHCs for persons needing medical assistance that meet the eligibility of the Illinois Public Aid Code, the Children's Health Insurance Program Act and the Covering All Kids Health Insurance Act.
CO 2005 HB 1262 Pending Appropriates funds to qualifying primary care providers.  Establishes criteria for "qualifying providers", and includes FQHCs in the definition. Allows qualifying providers to receive funds in proportion to the number of medically indigent they serve. Includes a provision that qualifying providers give demographic and other information to the state on a yearly basis to justify their funds. Requires state consultation with providers, including FQHCs, concerning the implementation, administration and allocation of money.

 

Capital Development

OH 2008 HB 562 Enacted Makes a grant available through Third Frontier Wright Capital for the Perry County Community Health Center at Hocking College and creates a physician loan repayment advisory board that consists of a representative of the Ohio Association of Community Health Centers.
HI 2008 HB 3008 Failed Provides a tax credit for improvements made to federally qualified health centers.
SC 2008 HB 3590 Failed Authorizes the state to acquire property under the Federal Property and Administrative Services Act of 1949 and distribute such property to non-profit health centers.
IL 2008 SB 2037  Pending Specifies that when the state is selling property they should first give priority to certain entities including health centers.
LA 2007 HB 765  Enacted  Appropriates funds for statewide community primary care clinic planning, acquisition and construction. Requires that the administration develop and implement a plan to disburse the funds in accordance with the state's health care redesign activities. Provides that the Commissioner of the Department of Administration may do all things necessary with funds appropriated for health clinics to leverage the federal new markets tax credit program or any other federal tax program, to include hiring a non-profit to determine how best to maximize tax benefits.

 

Health Information Technology (HIT)

MD 2009 HB 706 / SB 744 Introduced This bill  requires  the Maryland Health Care Commission to adopt  regulations by specified dates regarding adoption and certification of electronic health records (EHR) and  reimbursement  of  providers  by “State-regulated  payers” for  costs  associated with adopting EHR.
NH 2009 SB 147 Introduced Relative to the data collection practices of health care providers and relative to the development of a comprehensive uninsured health care database.
NC 2008 HB 2241/SB 1802 Failed Creates a Legislative Study Commission on Electronic Health Information to develop a coordinated statewide electronic health information network and will seek consulation from potential participtants, including CHCs.
MA 2008 SB 2650 Pending Includes CHCs in proposals for electronic medical records as well as a tuition and loan forgiveness program and a community development housing grant and loan program.
DC 2007 LB 2 Enacted Appropriates funds for electronic health records system in community health centers:  "(B) Of the remainder of the grant, $2.2 million in fiscal year 2007 and $2.8 in fiscal year 2009, shall be used to develop an electronic health record system for community health centers to promote higher quality of care, improved coordination of services among providers, and more accurate reporting of health statistics to the Department of Health; provided, that of the $2.2 million allocated for fiscal year 2007, $200,000 shall be used to support information technology needs for District of Columbia public and charter school nurse suites."
GA 2007 HB 94 Enacted Appropriates funds to The Georgia Association for Primary Health Care to complete the statewide Electronic Medical Records system in order to link the Federally Qualified Community Health Centers.
MN 2007 SB 2/HB 297 Failed Proposes an amendment to the Constitution to affirm state residents’ right to affordable health care; enacts other non-constitutional legislation to include electronic medical records:  "By January 1, 2015, all hospitals and health care providers must have in place an interoperable electronic health records system within their hospital system or clinical practice setting. The commissioner of health, in consultation with the Health Information Technology and Infrastructure Advisory Committee, shall develop a statewide plan to meet this goal The commissioner shall distribute the funds appropriated under this section to federally qualified health centers operating in Minnesota as of January 1, 2007. The amount of each subsidy shall be in proportion to each federally qualified health center's amount of discounts granted to patients during calendar year 2006."

 

Medicaid

FL 2008 SB 1508  Failed  Authorizes Agency for Health Care Administration to enter into contracts with traditional providers of health care to low-income persons and assist them in developing Medicaid prepaid health plans.  FQHCs are specifically listed as providers the agency may contract with.

Reimbursement/PPS

HI 2008 HB2795/SB 2542 Enacted The purpose of this Act is to ensure that the community health center system remains financially viable and stable to meet the increasing and changing health care needs of the population of uninsured and underinsured residents by creating an appropriate process for community health centers and rural health clinics to receive supplemental Medicaid payments and seek modifications to their scope of services.
IN 2008 SB 116/SB 164 Enacted This bill requires OMBB to reimburse Federally Qualified Health Centers and Rural Health Clinics using a prospective payment methodology.
IL 2008 HB 5192 Pending Subject to federal approval, the Department shall establish a rate methodology for mammography at federally qualified health centers and other encounter-rate clinics.
CA 2008 SB 260 Vetoed Would allow health centers to bill for more than one visit per day with the same provider or different provider under certain circumstances.
IA 2008 HB 2697 Failed Includes $650,000 to continue the incubation grant program for community health centers and specifies that FQHCs shall receive cost-based reimbursement for 100% of reasonable costs for the provision of services to recipients of medical assistance. 

 

Medical Homes

WV 2009 HB 3022 Introduced Creating a medical home health care plan for uninsured adults.  Medical Homes shall include a variety of services including pharmaceutical programs offered by certain CHCs.
HI 2009 SB 1094 / HB 894 Amended Establishes a pilot program to direct payment of certain state funds to federally qualified health centers to support federally qualified health centers as patient-centered health care homes. Makes an appropriation.
FL 2008 HB 1437/SB 2316 Failed Creates a discount health care card pilot program in Miami-Dade County creating an alliance between providers including FQHCs to provide primary care at a discounted rate.  Department of Health should negotiate reduced rates from providers and coordinate services to ensure county residents have a medical home.

 

Workforce

CT 2009 HB 5172 Amended An act that establishes the Connecticut Healthy Steps Program.  Which includes that the Department of Public Health shall establish and offer incentives for physicians in private practice who provide their services for at least four hours to federally qualified health centers. Such incentives may include, but not be limited to, reduced cost medical malpractice insurance offered or arranged for by the department and loan forgiveness from postsecondary educational institutions that receive funding from the state and partial payment of educational loans.
HI 2009 HB 169 Amended Establishes the Hawaii health corps that provides annual stipends to physicians and dentists who work in health professional shortage areas and shortage specialties; establishes the Hawaii health corps special fund.
HI 2009 SB 416 Introduced Establishes the Hawaii health corps program to address physician shortages in rural areas of the State; establishes a loan repayment program and an incentive plan for the recruitment of health care professionals to serve shortage areas.
MO 2009 SB 418 Introduced Enacts provisions for faith-based community health centers to provide limited liability insurance to medical professionals
NM 2009 HB 231 Fiscal Note appropriates $230,000 from the general fund to the Higher Education Department (HED) for the purpose of increasing the number of slots for dental students seeking support from the Western Interstate Commission for Higher Education (WICHE).  Bill mentions shortage of dental personnel in CHCs.
TX 2009 HB 3469 / SB 1476 Introduced Relating to the authority of a community health center to contract with or employ an optometrist or therapeutic optometrist.
WA 2009 HB 1047 Fiscal Note Creates a family medicine residency training grant program, and requires the Department of Health (DOH) to disburse grant funds to at least three accredited, three-year family medicine residency programs sponsored or sited at community health centers in rural or urban medically underserved areas.
WA 2009 SB 5502 Introduced Establishing the primary care physician conditional tuition waiver program.
MA 2009 SB 2901 Introduced A registered dental hygienist practicing as a public health dental hygienist may perform in a public health setting (including FQHCs), without the supervision or direction of a dentist, any procedure or provide any service that is within the scope of his practice and that has been authorized and adopted by the board as a delegable procedure for dental hygienists in private practice under general supervision.
MN 2009 HB 1645 Introduced Make grants available to organizations, such as CHCs, for programs to provide specialized training and work experience for
targeted youth who have not been served effectively by the current educational system.
MO 2009 SB 361 / HB 679 Introduced Authorizes the issuance of limited licenses for retired dentists, to practice primary and preventive care services at FQHCs and non-profit HCs.
CO 2008 SB 220 Enacted Allows an FQHC or rural health clinic to employ a physician as long as the clinic doesn't limit or exercise control over the physician's independent judgement and doesn't offer the physician any percentage of fees charged to patients by the center
NY 2008 HB 9808/SB 6808 Enacted Appropriates $5 million to be directed to support clinical training of medical students in free-standing abulatory facilities, including CHCs

TN 2008 SB 2937 Failed Exempts federally qualified health centers from complying with certain rules promulgated by the board of medical examiners so long as such agencies meet the standards in effect on January 1, 2008.
MA 2008 HB 4783 Pending Establishes the Clara Barton Scholarship program to provide scholarships in approved MA colleges, universities and schools of nursing for the purpose of encouraging outstanding MA students to work in various health settings, including CHCs.
HI 2008 SB 2415 Failed Authorizes prescriptive authority for qualified psychologists who practice at a federally qualified health center.
WA 2008 HB 2784/SB 6665 Failed Implements a pilot program that provides intensive case management to persons with a primary chemical dependency diagnosis or dual primary chemical dependency and mental health diagnoses, through the employment of chemical dependency case managers. The chemical dependency case managers shall coordinate with federally qualified health centers, Indian health programs, and Veterans' health programs for which the person is eligible to reduce duplication of services and conflicts in case approach.
TN 2008 HB 4011/SB 3122 Enacted Allows a registered nurse or certified pharmacy technician in an FQHC to dispense prescription drugs without the direct, on-premises supervision of a pharmacist when the pharmacist provides supervision of the dispensing by means of telepharmacy/telemedicine technology.
MA 2008 SB 2650 Pending Includes CHCs in proposals for electronic medical records as well as a tuition and loan forgiveness program and a community development housing grant and loan program.
MA 2008 HB 4701/SB 2714 Pending Appropriates money to CHC for various programs, including $1,700,000 for a primary care workforce development and loan forgiveness grant program.
HI 2007 SB 977 Failed Appropriates funds to develop a statewide rural training model to provide a pipeline of well trained family physicians to improve health care access: "The partial costs of starting the two new academic clinical practices on the neighbor islands total $870,000 in fiscal year 2008 and $1,890,000 in fiscal year 2009. They include the costs of eight faculty physician salaries, clinic infrastructure improvements, transportation, and electronic health records.  The sustainability of this model will be accomplished through a combination of CMS funding, clinical revenue, and support from rural hospital and community health center partners similar to programs adopted successfully in other rural states such as Washington and Wisconsin."

 

Dental

FL  2008  SB 2760  Enacted  Allows out-of-state dentists who meet certain criteria to practice in "health access settings", including community health centers, without the supervision of a dentist licensed in FL.
FL 2008  HB 1367  Failed  Defines "public health settings" which includes FQHCs and look-alikes; defines "public health supervision";  creates licensure by credentials for certain dentists who receive public health dental license; requires that such dentists practice in public health settings.
HI 2008  SB 2543  Failed  Appropriates funds to the department of health for the establishment or expansion of community-based dental health clinics that are operated by federally qualified health centers to provide a continuum of dental care to Medicaid and QUEST eligible adults and children, the developmentally disabled, and the uninsured.
NE 2008  LB 795  Failed  Each of the 5 health centers would receive a one time appropriation of $300,000 to expand oral health care.

 

Mental Health

VT 2008 HB 887 Enacted Appropriates $100,000 to the VT Dept of health for the child psychiatry division in the VT Center for Children, Youth and Families to support child tele-psychiatry pilots in CHCs.
HI 2008 SB 2415 Failed Authorizes prescriptive authority for qualified psychologists who practice at a federally qualified health center.

Prescription Drugs

ID 2009 SB 1109 Fiscal Note The Idaho Legend Drug Donation Act would establish a program under the Board of Pharmacy pursuant to which pharmacies, hospitals, nursing homes and drug manufacturers and distributors could donate legend drugs to qualifying community health centers and free clinics. The community health centers and free clinics that elect to participate in this program would, in turn, be allowed to dispense those drugs, pursuant to valid prescriptions, to medically indigent patients.
KS 2008 HB 2578 Enacted Authorizes the redistribution of unused drugs to qualifying entities, including FQHCs, who in turn will provide the medications to the indigent.
ME 2008 HB 1591 Enacted The purpose of this bill is to reduce the cost of prescription drugs purchased by the State and counties by expanding access to discounted prescription drugs under the federal 340B program. The bill includes FQHCs and look-alikes.
UT 2008 HB 74 Enacted The department shall, in accordance with this section, expand the state Medicaid program's use of savings under the 340B drug pricing program. The department shall determine work with the Association for Utah Community Health to identify and assist community clinics that do not have 340B drug pricing programs to determine whether, under applicable federal law  the patients of the community health center would benefit from establishing a 340B drug pricing program either on site, or through a contract with a pharmacy provider.
UT 2008 HB 47 Enacted Beginning May 21, 2008, requires Department to report on a quarterly basis to the Legislature's Health and Human Services Interim Committee and HHS Approprations Subcommittee on the progress towards implementing an expansion of the use of the 340b drug pricing program by CHCs.
HI 2008 SB 2406 Failed Requires board of pharmacy to allow telepharmacy by certain federally qualified health centers participating in the federal 340B Pharmaceutical Purchasing Program.
HI 2008 SB 2531 Failed Authorizes appropriately trained and supervised licensed medical psychologists practicing in federally qualified health centers, to prescribe psychotropic medications for the treatment of mental illness

DC 2008 LB 513 Enacted Establishes the DC Medical Liability Captive Insurance Agency to provide medical malpractice liability coverage for CHCs in DC
MO 2008 SB 1210 Failed This act provides that the professional corporations of physicians that provide uncompensated care, including health centers, shall also be covered under the state legal expense fund, and also adds tax-exempt charitable health care center referral networks to the list of authorized referral sources for purposes of coverage.
GA 2008 HR 1109 Adopted Recognizes February 13, 2008, as "Community Health Centers Day".
SC 2008 HR 4967 Adopted Commends staff at Margaret J. Weston CHC in Aiken County for their outstanding leadership in treatment of the medically underserved and congratulates them for being named the recipient of a 2008 Johnson and Johnson Crystal award.
VA 2008 HJR 279 Adopted A House Joint Resolution that thanks and commends CHCs that provide access to primary care and a "medical home", calls CHCs the pillars of the Commonwealth's safety net and commends the employees of CHCs.
FL 2008 HB 5085 Enacted Inclues FQHCs in the primary care disproportionate share program
FL 2008 HB 5003 Enacted Establishes an alliance of hospitals, FQHCs, free clinics, physician groups and other health care providers in Miami-Dade County for the purpose of increasing access to and coordination of care.
MN 2008 HB 3372/SB 3245 Enacted Introduces uniform billing form CMS 1450, to be used by FQHCs that are not being billed using an equivalent electronic billing format.
